1. ELIGIBILITY: Hult Lost Sock Giveaway (the “Giveaway”) is open to individuals who are at least 18 years of age at the time of entry (“Entrant”). Employees, officers and representatives of Hult Fritz Matuszak Inc, (the “Sponsor”) or their suppliers, as well as their immediate family (spouse, parents, siblings, and children) and household members of each such employees or suppliers are not eligible. Subject to all federal, state and local laws and regulations. Odds of winning in this particular drawing depend on the number of eligible entries received for the drawing. The Giveaway is subject to all applicable federal, state, local laws and regulations.
2. SPONSOR: Hult Fritz Matuszak Inc, 401 SW Water St., #601, Peoria, IL 61602.
3. AGREEMENT: By participating in the Giveaway, each Entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Sponsor in all matters relating to this Giveaway, which are final and binding.
4. TIMING: The Giveaway begins June 12, 2009 at 12:01:00 a.m. Central Standard Time ("CST") and ends at 11:59:59 p.m. CST on July 10, 2009, (the "Promotion Period").
5. ENTRY: Entrants who complete and submit the survey will each automatically receive one (1) entry into the Giveaway. YOU MAY ONLY ENTER THE Giveaway ONCE. DUPLICATE ENTRIES WILL BE DELETED AS DETERMINED BY THE SPONSOR. Although subsequent attempts to enter may be made, only the first entry from a particular individual will count, subsequent attempts to enter will be disqualified. Use of any automated system to submit entries is prohibited and will result in disqualification. In the event of a dispute as to any entry, the authorized account holder of the mobilephone number/email address associated with the Giveaway will be deemed to be the Entrant. The "authorized account holder" is the natural person assigned the mobilephone/email address used for the Giveaway by a Cellular Phone provider/ Internet access provider, online service provider or other organization responsible for assigning mobilephone/email addresses for the phone number/domain associated with the submitted phone number/email address. Potential winners may be required to show proof of being the authorized account holder.
6. DRAWING: The prize drawing will be conducted randomly from amongst all eligible Entrants in accordance with these Official Rules on or about July 10, 2009. The drawing will be conducted in accordance with these Official Rules by Sponsor, and the selection of the potential winner is final. Entrants selected must comply with all terms and conditions of these Official Rules. Winning is contingent upon fulfilling all requirements. Winners will be notified using the email address and/or phone number submitted along with their survey. Winners must be at least 18 years of age at the time of entry to be eligible. Potential winners consent to being contacted by the sponsor via email or phone for the purposes of communicating about the Giveaway. If a potential winner cannot be contacted within five (5) days after the first attempt to contact him/her, Sponsor may at its sole and absolute discretion select an alternate Entrant from among all eligible entries received.
7. PRIZE: One (1) winner will receive one (1) new Maui Jim® Turtle Bay Sunglasses valued at $350 MSRP.
8. PUBLICITY: Except where prohibited, participation in the Giveaway constitutes winner's consent to Sponsor's use of winner's name, likeness, voice, opinions, biographical information, city and state for advertising and promotional purposes in any media worldwide without additional notice or further payment or compensation, except where prohibited by law, including but not limited to publication of winner/guest list on any of Sponsor's websites.
9. CONDITIONS: Sponsor reserves the right to cancel or modify the Giveaway if fraud, technical failures or any other factor beyond Sponsor's reasonable control and impairs the integrity of the Giveaway, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these Official Rules, or in a disruptive manner. Any attempt by any person to deliberately damage the sponsor or undermine the legitimate operation of the Giveaway is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
10. RELEASE: By entering this Giveaway, Entrant agrees to release and hold harmless, the Sponsor its related companies, its parent and affiliates and each of their respective officers, directors, employees, shareholders, and agents from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of any prize.
11. LIABILITY: Sponsor is not responsible for: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Giveaway; (iv) electronic or human error which may occur in the administration of the Giveaway or the processing of entries; or (v) any injury or damage to persons or property, including but not limited to Entrant’s computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Giveaway.
12. DISPUTES: Entrant agrees that any and all disputes, claims and causes of action arising out of or connected with this Giveaway, or any prizes awarded, other than the administration of the Giveaway or the determination of winners shall be resolved mutually, without resort to any form legal action. If any causes or controversies arising out of the Giveaway cannot be mutually resolved, Entrant hereby consents to the exclusive jurisdiction and venue of Illinois courts (state and federal) in Peoria County.
13. RULES/WINNER: A copy of these Official Rules may be obtained by sending a self-addressed, stamped envelope to Hult Lost Sock Giveaway, c/o Hult Fritz Matuszak Inc, 401 SW Water St. #601, Peoria, IL 61602. All Entrants with a valid email address will receive notification of the winner once the winner has been confirmed.
